Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Brothly mobile application and related services (together, the "Service"). Please read them carefully.

By downloading, installing, or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. Who We Are

Brothly is a voice-first cooking assistant. We help you plan meals, cook along with an AI agent, and save memories of dishes you make at home. With your permission, we may also send push notifications for cooking reminders, subscription and trial status, and occasional service updates; you can disable them at any time in iOS Settings.

2. Eligibility

Brothly is rated 4+ on the App Store and is suitable for all ages. Users under the age of majority in their country should have a parent or guardian review these Terms. By using the Service, you represent that you are legally able to agree to these Terms, or that your parent or guardian has done so on your behalf.

3. Your Account

You can sign in with Sign in with Apple or Google Sign-In, or use the App as a guest. You are responsible for keeping your account credentials secure and for all activity that occurs under your account. Notify us promptly if you suspect unauthorized use.

4. Subscriptions, Trials, and Billing

Certain features require a paid subscription. Brothly currently offers two auto-renewing subscription tiers, Brothly Plus and Brothly Pro, sold through the Apple App Store and subject to Apple's standard terms. The exact subscription length, price, and any introductory or free-trial offer are shown on the in-app paywall before you confirm a purchase, and are also listed on the App Store product page.

• Payment. Payment is charged to your Apple ID account at confirmation of purchase.
• Auto-renewal. Your subscription automatically renews at the end of each billing period at the price of the selected package unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.
• Free trials and introductory offers. Where a free trial or introductory price is offered, the subscription will automatically convert to a paid subscription at the standard price at the end of the trial unless you cancel at least 24 hours before the trial ends. Any unused portion of a free trial period is forfeited when you purchase a subscription that includes a free trial.
• Manage and cancel. You can manage or cancel your subscription, or turn off auto-renew, at any time in Settings -> your Apple ID -> Subscriptions on your device. Cancellation takes effect at the end of the current billing period.
• Refunds. Refunds are handled by Apple in accordance with its policies; we cannot issue App Store refunds directly.
• Price and plan changes. Prices, plan features, and trial terms may change from time to time. Where required, we (or Apple on our behalf) will notify you before a change affects an active subscription.

5. Health, Safety, and Cooking Disclaimer

Brothly provides recipes, cooking guidance, and ingredient suggestions for general informational purposes only. The Service is not a substitute for professional medical, nutritional, or food-safety advice.

• Always verify ingredient labels yourself, especially for allergens, intolerances, and dietary restrictions. AI-generated content can be incorrect or incomplete.
• Follow safe cooking practices, including safe handling temperatures, sharp tools, and heat sources. You are responsible for your own kitchen safety.
• If you have allergies or medical conditions, consult a qualified professional before relying on any recipe, suggestion, or nutritional claim produced by the Service.

6. Acceptable Use

You agree not to:

• Use the Service to violate any law, regulation, or third-party right.
• Reverse engineer, decompile, or attempt to extract source code or model weights, except to the extent permitted by law.
• Interfere with, overload, or disrupt the Service or the infrastructure supporting it.
• Use automated systems to scrape or extract data from the Service without our written permission.
• Upload content that is unlawful, infringing, harassing, or otherwise harmful, or submit voice or image input containing other people without their consent.
• Use the Service to generate content that could cause harm, including instructions intended to endanger health or safety.

7. Your Content

You retain ownership of the feedback, photos, voice input, and other content you submit through the Service ("Your Content"). You grant us a worldwide, non-exclusive, royalty-free license to host, process, and use Your Content solely as necessary to operate and improve the Service. We will not sell Your Content.

You are responsible for Your Content and represent that you have the rights necessary to submit it.

8. AI-Generated Output

The Service uses third-party AI models to generate recipes, spoken responses, and visual analysis. Output is probabilistic and may contain inaccuracies or unexpected results. You should exercise judgment before acting on any output, particularly around food safety, allergens, and dietary claims.

9. Third-Party Services

The Service integrates with third parties, including Apple, Google, ElevenLabs, Spoonacular, RevenueCat, Mixpanel, and Sentry. Your use of those services may be subject to their own terms and privacy policies. We are not responsible for third-party services.

10. Intellectual Property

The Service, including its software, design, trademarks, and non-user content, is owned by Brothly or its licensors and is protected by intellectual property laws. Subject to these Terms, we grant you a limited, personal, non-transferable, non-exclusive license to use the App on devices you own or control, for personal, non-commercial purposes.

11. Beta and Experimental Features

We may offer features labelled as beta, preview, or experimental. These features are provided "as is", may be changed or withdrawn at any time, and may be less reliable than generally available features.

12. Termination

You may stop using the Service at any time and delete your account from the Profile screen. We may suspend or terminate your access if you violate these Terms, if required by law, or if continued provision of the Service becomes impractical. Sections that by their nature should survive termination will survive, including sections 5, 7, 10, 13, 14, and 16.

13. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT RECIPES OR AI OUTPUT WILL BE ACCURATE OR SUITABLE FOR YOUR CIRCUMSTANCES.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BROTHLY AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL ARISING FROM OR RELATING TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) USD $20. SOME JURISDICTIONS DO NOT ALLOW THESE LIMITATIONS; IN THOSE JURISDICTIONS OUR LIABILITY IS LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.

15. Changes to the Service or Terms

We may modify the Service or these Terms at any time. If changes are material, we will update the "Last updated" date above and, where appropriate, notify you in the App. Your continued use after changes take effect constitutes acceptance of the revised Terms.

16. Governing Law and Disputes

These Terms are governed by the laws of the State of California and the federal laws of the United States applicable therein, without regard to conflict-of-laws rules. You agree that any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in California, and you consent to the personal jurisdiction of those courts, except where mandatory local consumer law gives you the right to bring a claim in the courts of your place of residence.

17. Apple-Specific Terms

If you download the App from the Apple App Store, you acknowledge and agree that: these Terms are between you and Brothly (not Apple); Apple has no obligation to provide support or maintenance for the App; in the event of any failure of the App to conform to any applicable warranty, you may notify Apple and Apple may refund the purchase price, and to the maximum extent permitted by law, Apple has no other warranty obligation; Apple is a third-party beneficiary of these Terms and may enforce them against you.
